Cordial greetings;

The undersigned Ahmed Seif El Islam Abdel Fattah Hamad, lawyer, carrying bar association ID no. 88678 and am the executive director of the Hisham Mubarak Law Center.

Subject: Request to appoint an investigation magistrate to investigate the events of my following complaint

Against: Head of State Security Intelligence, Head of the General State Intelligence and citizen Hosni Mubarak.

Events:

I live with my family in apartment no. 5, building no 8 in Mab’uthin city in front of the Boulaq general hospital, which is only tens of meters away from the police station of Boulaq El Dakrur police station. Around 12 o’clock noon time my daughter left the house, using her keys to close the front door of the apartment. At about 1.30 a family friend arrived at the apartment to take his laptop. He found the apartment door unlocked. Inside the apartment he observed that all drawers in the living room and three other rooms have been searched, the papers had been messed with, the closets were open and their contents were all over the place, including the drawers of the beddable of my youngest daughter. He also observed that his laptop was missing. He phoned me from the home telephone. I immediately went to the Boulaq El Dakrur police station and met with the chief of police and one of the intelligence officers at the station and requested to file a complaint against the aforementioned subjects. I was hosted at the police station for over two hours, during which they made several phone calls until they registered my complaint, the content of which I shall describe below. The deputy to the chief of police and an intelligence assistant came to my house to study the location and promised to inform me of the number of my complaint on the same evening.

Factual reasons for accusing the aforementioned individuals:

1. The search was restricted to documents and the lap top. Nothing else was stolen from the apartment, including money and gold.
2. The search took place at the same time of the demonstration that was organized today in front of Cairo university upon the call of the Popular Campaign for Change with other actors to declare the demands of the Egyptian people refusing a new mandate for citizen Hosni Mubarak, the succession of his son to the presidency and calling for a multi candidate presidential election. I am honored to be one of the activists of that campaign.
3. Also, the search was only a few hours away from the press conference which will be organized tomorrow, Tuesday at the office of the Hisham Mubarak Law Center together with the American organization of Human Rights Watch and the Egyptian Association against Torture and the Hisham Mubarak Law Center to disclose the results of their fact finding mission regarding the arrests in North Sinai.
4. During my participation in the 4th of February demonstration at the book fair, which again was organized by the Popular Campaign for Change, one of the state security intelligence officers threatened me that if I do not stop my opposition to citizen Hosni Mubarak and his son, it will be so easy to fabricate a case of drugs or debauchery against me.
5. This harassment is not the first. While I was in North Sinai on the fact finding mission whose results we shall announce tomorrow, my apartment was opened, searched and my personal lap top was taken.
6. In 2003, together with others, I submitted a complaint to you against citizen Hosni Mubarak accusing him of the criminal responsibility of the crimes committed by the Egyptian police against Egyptian demonstrators who protested the Anglo American war against Iraq. The complaint was registered under the number 2889/2003 on the 5th of April 2003.

From all of the above it is most likely that the theft was not done by a usual thief, but was an attempt to terrorize, threaten and intimidate one of the opponents of Hosni Mubarak and his son, indicating the involvement of one of the police apparatuses who control the means to break into citizens’ apartments and search them.

Why do I demand a magistrate?

Since the surrounding circumstances of the event make it more likely that it was politically motivated to terrorize the opponents of the chairperson of the national party;

And to ensure the impartiality of the interrogator, and enforcing your authorities listed in article 64 of the law of criminal procedures to appoint a magistrate to undertake the investigation in those events, which, if confirmed, would represent a stigma to all who permitted it, covered for it, were involved in it, refrained from challenging it or camouflaged it. The aforementioned article granted this authority to the general prosecution if it judges that investigating the complaint by a magistrate is more appropriate considering the special circumstances of the event.

In that regard I would like to quote the ruling of the Emergency State Security Court issued on the 11th of February 1990 in general prosecution case no. 2830/1986, as a legal ground to base my demands.

It said:

“The court, as it is wronged by the defaming that has reached the investigations of the general prosecution, based on reasons that have been proved and documented, calls for a change of legislation to the effect that only magistrates should carry out the investigations in cases of conscience. The accused in cases of political nature should be able to demand the appointment of a magistrate, to the effect that any procedure of interrogation would be annulled if the demand of the accused is not fulfilled or if obstacles are put to prevent a magistrate from carrying out the investigation.”

Therefore

I submit my present complaint for legal procedures to be undertaken

الموضوع: طلب ندب قاضى تحقيق ليتولى التحقيق فى وقائع بلاغى هذا:

المبلغ ضدهم: ضد رئيس جهاز مباحث أمن الدولة وضد رئيس جهاز المخابرات العامة وضد المواطن حسنى مبارك.

الوقائع:

أقيم مع أسرتي فى الشقة رقم 5 من العقار رقم 8 بمدينة المبعوثين أمام مستشفى بولاق، والتى تبعد عن قسم شرطة بولاق الدكرور بعشرات الأمتار، انصرفت نجلتى من المنزل حوالى الساعة الثانية عشر ظهرا تقريبا وأغلقت باب الشقة الخارجى بالمفتاح وفى تمام الساعة الواحدة والنصف قدم أحد أصدقاء العائلة ومعه مفتاح سكنى ليسترد جهاز الكمبيوتر المحمول الخاص به، فوجد باب السكن غير مغلق بالمفتاح، ووجد كافة الأدراج فى الصالة وفى ثلاث حجرات مفتوحة وتم العبث فى الأوراق التى بها، وأبواب وأدراج خزن الملابس الثلاثة مفتوحة ومحتوياتها مبعثرة، وأيضا أدراج سرير ابنتى الصغرى، كما تبين له عدم وجود جهاز الكمبيوتر المحمول الخاص به، فاتصل بى من تليفون المنزل فسارعت للتوجه لقسم شرطة بولاق الدكرور وقابلت نائب المأمور واحد ضباط المباحث فى القسم طالبا تحرير بلاغ بالواقعة متهما فيها الأشخاص المذكورين.

فتم استضافتى مدة من الزمن تقترب أن لم تزيد عن الساعتين، لإجراء اتصالاتهم بجهات ما حتى تم تحرير محضر بالواقعة سأذكر مضمونه فيما بعد، وانتقل نائب المأمور ومعاون المباحث لمعاينة سكنى، ووعدوا أن رقم المحضر سوف اعرفه فى مساء اليوم.

الأسباب الواقعية التى تجعلنى اتهم الأشخاص المذكورين:

1. اقتصار التفتيش والعبث على الأوراق وجهاز الكمبيوتر المحمول. ولم تسرق أية أشياء أخرى كأموال أو ذهب.
2. تزامن ذلك مع المظاهرة التى تمت اليوم أمام جامعة القاهرة بمبادرة من الحملة الشعبية للتغيير مع شركاء آخرين لإعلان مطالبها للشعب المصرى بعدم التجديد للمواطن حسنى مبارك وعدم توريث الحكم لابنه جمال وانتخاب رئيس الجمهورية من بين اكثر من مرشح، وهى الحملة التى اشرف أن أكون أحد نشطائها.
3. ما تم يسبق بساعات معدودة المؤتمر الصحفى المزمع عقده غدا الثلاثاء بمقر مركز هشام مبارك للقانون بالاشتراك مع منظمة مراقبة حقوق الإنسان الأمريكية والجمعية المصرية لمناهضة التعذيب، ومركز هشام مبارك لإعلان نتائج بعثة تقصى الحقائق لاعتقالات المواطنين فى شمال سيناء.
4. وأثناء مشاركتى فى مظاهرة 4 فبراير فى معرض الكتاب والتى دعت إليها الحملة الشعبية من اجل التغيير قام أحد ضباط مباحث أمن الدولة بتهديدى إذا لم أتوقف عن معارضة المواطن حسنى مبارك ونجله بقوله ما اسهل الزج بك فى جريمة آداب أو مخدرات.
5. تكرر هذا الأمر من قبل أثناء إقامتي فى شمال سيناء بخصوص ذات بعثة تقصى الحقائق التى سنعلن تقريرها غدا، تم دخول شقتى والعبث فى محتوياتها والاستيلاء على جهاز كمبيوتر محمول خاص بى.
6. سبق لى فى غضون عام 2003 وان تقدمت صحبة آخرين ببلاغ لسيادتكم ضد المواطن حسنى مبارك وآخر متهما إياهما بالمسئولية الجنائية عن الجرائم التى ارتكبها البوليس المصرى ضد المصريين المتظاهرين احتجاجا على العدوان الانجلو أمريكي على العراق وقيدت برقم 2889/2003 عرائض النائب العام فى 5/4/2003

يرجح كل ذلك أن ما تم ليس بسرقة ارتكبها مجرم عادى وإنما هى محاولة للترويع والتهديد والإرهاب لأحد معارضى المواطن حسنى مبارك ونجله، وهو ما يشير لتورط أحد الأجهزة البوليسية التى تملك قدرات اقتحام مساكن المواطنين.

لماذا طلب انتداب قاضى تحقيق:

حيث ترجح ملابسات الواقعة أنها ترجع لخلفيات سياسية لفرض الصمت رعبا على معارضى رئيس الحزب الوطنى،

ولضمان حيدة المحقق. وإعمالا لصلاحيتكم الواردة بالمادة 64 من قانون الإجراءات الجنائية بانتداب قاضى التحقيق ليتولى التحقيق فى هذه الوقائع التى لو صحت لشكلت وصمة عار على كل من سمح بها أو صمت إزائها أو تواطأ معها أو تخاذل عن مواجهتها أو تستر عليها. والمادة المذكورة منحت هذه الصلاحية للنيابة العامة إذا رأت أن تحقيق الدعوى بمعرفة قاضى تحقيق أكثر ملائمة بالنظر إلى ظروفها الخاصة.

ويحضرنى هنا ما سطره حكم محكمة أمن الدولة طوارئ الصادر فى 11 فبراير 1990 فى قضية النيابة العامة رقم 2830/ 1986 كلى وسط القاهرة كسند نرتكز عليه فى مطلبنا

حيث جاء فيه:

"وأن المحكمة وقد ساءها أن يصل التجريح إلى محاضر تحقيق النيابة العامة، ويكون محمولا على أسباب لها فى الأوراق دليل، فإنها تدعو إلى تعديل التشريع بحيث يتولى قضاة التحقيق وحدهم تحقيق قضايا الرأى، وأن يتيسر للمتهم فى القضايا ذات الطابع السياسى طلب ندب قاضى للتحقيق بحيث يبطل أى إجراء فى التحقيق إذا تم دون إجابة المتهم إلى طلبه أو إذا وضعت عراقيل تحول دون تولى التحقيق أحد القضاة "
